Funutation Tekademy LLC Terms & Conditions for All Course Sessions

PROGRAM TERMS & DETAILS

1. TUITION

1.1 Weekly Day Camp Tuition includes all state and federal taxes, instruction, course materials, adult supervision, and recreational activities (students need to bring their own lunch). Overnight Camp Tuition includes Day Camp Tuition items, meals (Sunday evening - Friday afternoon), bed, 24-hour adult supervision, and recreation.

After-School & Weekend programs includes all taxes, instruction, course materials, adult supervision, and recreational activities and run as described when purchased.

One-Day Samplers, and Tutoring include all taxes, instruction, course materials, adult supervision, and recreational activities and run as described when purchased.

Gift Certificates may be used for any of our classes.

1.2 Instruction for Weekly Day Camp begins at 9:00 AM and concludes at 3:00 PM (Monday- Friday), excluding an hour for lunch and an hour for activities. "Show and Tell" occurs Friday afternoon starting around 2:30PM and concluding at 3:30PM. Parents and guests are encouraged to attend "Show-and-Tell".

Instruction for One-Day Samplers begin at 9:00 AM and concludes at 5:30 PM excluding an hour for lunch and an 3 hours for activities.

2. PAYMENTS & CANCELLATIONS

2.1 Payments

Funutation Tekademy Camps MUST receive payment of all courses on or before the first day of the camp session. Lab fees must be paid on the first day of class of the weekly session. A $35 Returned check fee will be assessed for any checks returned. Funutation Tekademy Camps reserves the right to send any unpaid balances over 90 days to a collection agency.

2.2 Registration Changes

There will be a $25 administration fee for any camp reservation change once the camp week has been confirmed at the request of a parent. There is no fee if the request is made by Funutation LLC.

2.3 Refund / Cancellation Policy

No refunds will be issued for early withdrawal due to illness, absences, behavioral dismissals, power failures, unforeseeable events not within the control of Funutation Tekademy Camps, or other acts of nature. Students leaving early for any personal reasons are NOT prorated. Balance payments, less deposit, are refundable up until 3 weeks prior to the start of the confirmed camp week. No refunds will be issued for cancellations within 3 weeks of the start of confirmed camp week. All cancellations must be submitted in writing and submitted to the Funutation Tekademy Camps office no later than 3 weeks prior to the start of camp. Please note that refunds will not be issued without written confirmation from parent or guardian, stating that the camper's parent/guardian is aware of the Funutation Tekademy Camps cancellation policy and they understand that a deposit amount of $125 (per week/per student) is non-refundable. The cancellation may be emailed, mailed via United States Postal Service, or faxed. To cancel via email send to camps@funutation.com, note in the subject line "Cancellation". To cancel by mail via the United States Postal Service, send to: Funutation Tekademy Camps, Attention: Cancellation, 24700 Chagrin Road Suite 201A, Beachwood, OH, 44122. To cancel via fax send to 1-216-378-9476, Attention: Cancellation. If Funutation Tekademy Camps must cancel a session and cannot find a suitable alternative, we will issue a full refund.

3. PRIVACY POLICY

At Funutation Tekademy Camps, we take privacy very seriously, and we work hard to respect and protect you and your child's privacy by observing COPPA (Children's Online Privacy Protection Act) law standards as well as ACA (American Camping Association) standards.

3.1 We Do Not Share Your Information with Third Parties

Funutation Tekademy Camps does not sell your personal information to third parties.

3.2 Parent/Guardian Email Information

Parent/Guardian email address is not required information, unless submitting payment via the online registration system. (We are required by the major credit card companies to acquire this information in order to better protect your transactions.) If you request our email newsletter and announcements and provide an email address, Funutation Tekademy Camps will send our latest camp news directly to the parent/guardian. If they no longer wish to receive these messages, simply unsubscribe by selecting the "Unsubscribe" button.

3.3 Your Credit Card Information and Transactions Are Secure

For your convenience, you can pay for your orders by credit card over the phone or online. For online orders, we use high-security encryption technology to safeguard and protect your personal information and transactions. Your information, including your credit card information, is encrypted and cannot be read over the Internet.

3.4 Background Checks

Funutation Tekademy Camps requires criminal background checks for our Instructors and other Staff that will be at our camp locations. We take the safety and security of your child very seriously and require criminal background checks on anyone that is in contact with your child for the duration of the camp.

3.5 Testimonials

So as not to disturb our campers or parents, Funutation Tekademy Camps has permission to use any written responses you enter on our web forms for marketing purposes, including potential use on the website, brochure, catalog, flyers, press releases, and other marketing materials. Funutation Tekademy Camps may use part or all of the testimonial.

3.6 Projects & Games

Funutation Tekademy Camps makes reasonable effort to provide each student with a working game or project that will be mailed home (with the exception of the robotics, build and repair computer, and wiimote modding courses), or post the game or project to the funutation.com website. Due to the complexity of computers there may be instances when the game will not work on an individual's home computer. In these cases, Funutation Tekademy Camps does not take responsibility for projects that do not work. Please contact Funutation Tekademy Camps to request a duplicate, and we will retest it, and send to the student. If the tested duplicate does not function, Funutation Camps is under no obligation to pursue further resolution.

4. CHILDREN'S PRIVACY STATEMENT

4.1 Camp Pictures

All pictures taken at or in connection with Funutation Tekademy Camps are the sole and exclusive property of Funutation Tekademy Camps and may be used by the camp in any promotional materials and other print media for camp purposes. These pictures may also be used by our sponsors, the media, or other organizations who are working with Funutation Tekademy Camps. We do not sell or distribute these photos for any other purposes than those listed above.

4.2 "Camp Projects"

All projects and work created while at Funutation Tekademy Camps may be used by Funutation Tekademy Camps in promotional materials. Funutation Tekademy Camps will not mention any student's full name without prior parental consent. These projects may also be used by our sponsors, the media, or other organizations who are working with Funutation Tekademy Camps.

4.3 Consent - Your Responsibility Regarding the Use of Our Site

By submitting your personal information at funutation.com, you are accepting the privacy practices described in this policy statement.

5. OTHER INFORMATION

5.1 Funutation Tekademy Camps requires all of the following information about children. Data including allergies,illnesses, immunizations, medications, dietary restrictions, emergency contact information, height, weight, gender and date of birth. We require Primary & Secondary contacts in case of emergency. This information is to be completed by Parent/Guardian, and where required, by the student. Please provide updated and complete information. If you have any questions, please contact us at 1-216-378-9035. The information we collect is CONFIDENTIAL and is used to aid the Camp Staff regarding your child.If student should need to be restricted from any activity, you will be asked to inform us of such.

5.2 YOU HEREBY WAIVE AND RELEASE FUNUTATION TEKADEMY CAMPS LLC, ITS OWNERS, AGENTS, PARTNERS, SPONSORS, FACILITY PROVIDERS, AND EMPLOYEES FROM LIABILITY FOR ANY INJURY OR ILLNESS INCURRED WHILE AT CAMP. YOU UNDERSTAND THAT THERE IS RISK OF INJURY TO THE NAMED STUDENT AS A RESULT OF CAMP ACTIVITIES, AND KNOWINGLY AND VOLUNTARILY ASSUME ALL RISK OF SUCH INJURY. By submitting the information, it certifies that you, the Parent/Guardian, agree to the terms stated above, and have taken the time to ensure that ALL information in the HEALTH AUTHORIZATION AND RELEASE FROM LIABILITY FORM IS UP-TO-DATE AND ACCURATE TO THE BEST OF YOUR KNOWLEDGE.ON BEHALF OF YOUR SON/DAUGHTER/WARD, YOU HEREBY RELEASE FUNUTATION TEKADEMY CAMPS LLC, ITS OWNERS, AGENTS, PARTNERS, SPONSORS, FACILITY PROVIDERS AND EMPLOYEES FROM LIABILITY (INCLUDING CLAIMS BASED UPON NEGLIGENCE) FOR DAMAGE OR INJURY TO YOUR SON/DAUGHTER/WARD OR DAMAGE OF ANY PERSONAL PROPERTY, ACCEPTING YOURSELF THE FULL RESPONSIBILITY FOR ANY AND ALL SUCH DAMAGE OR INJURY WHICH MAY RESULT DIRECTLY OR INDIRECTLY FROM ANY NEGLIGENT ACTS OR ACTIVITIES ASSOCIATED WITH FUNUTATION TEKADEMY CAMPS LLC. HOWEVER, I UNDERSTAND THAT I AM NOT RELEASING FUNUTATION TEKADEMY CAMPS LLC, ITS OWNERS, AGENTS, PARTNERS, SPONSORS, FACILITY PROVIDERS, AND EMPLOYERS FROM GROSS NEGLIGENCE, RECKLESS CONDUCT OR INTENTIONALLY TORTIOUS CONDUCT. TO THE EXTENT THIS RELEASE CONFLICTS WITH STATE LAW GOVERNING RELEASES, THIS RELEASE IS TO BE GIVEN THE FULLEST FORCE AND EFFECT PERMITTED UNDER STATE LAW. IF THIS RELEASE IS DETERMINED TO BE INVALID UNDER THE LAWS OF THE GOVERNING STATE, THEN THIS RELEASE SHALL BE STRICKEN FROM THIS CONTRACT, BUT ALL OTHER TERMS AND CONDITIONS OF THIS AGREEMENT SHALL REMAIN IN FULL FORCE AND EFFECT.

5.3 Lost, Stolen or Damaged Property.

Funutation Tekademy Camps does not owe a duty to protect its participants from theft or damage to property. We do not hold Funutation Tekademy Camps responsible for any lost, stolen, or damaged personal items brought to camp. If any theft of or damage to a child's property should occur at camp, or in association with the camp, Funutation LLC will not be held responsible. Physical and Recreational Activities such as Sports, outdoor, and other recreational activities contain inherent risks. You are aware that the child may be participating in activities such as sports, hiking, swimming and other recreational activities, and that such activities contain inherent risks of injuries. You assume all risks and understand that Funutation Tekademy Camps LLC, its owners, agents, partners, sponsors, facility providers, and employees will not be held liable for damages or injuries associated with recreational activities, including any and all claims based on negligence. You understand that you must report any and all injuries immediately to Funutation Tekademy Camps LLC. Should any part of this contract be found invalid or not enforceable by a court of law, then the remaining portion shall continue to be valid and in force.

5.4 The camp has the right to dismiss any individuals if their actions or attitudes are deemed detrimental, as set forth below in the Funutation Tekademy Camps Code of Conduct, to the general atmosphere of thecamp and that there shall be no refunds issued for such dismissal.

5.5 All pictures and video taken at or in connection with Funutation Tekademy Camps are the sole and exclusive property of Funutation and may be used by Funutation LLC in camp promotional materials, marketing collateral, and online media for camp purposes. These pictures and videos may be shared and used by sponsors, the media, or other organizations who work with Funutation Tekademy. You understand that Funutation Tekademy, its owners, agents, partners, faculty providers, and employees will not be held liable for damages and injuries associated with said publishing, including any and all claims based on negligence. Please note that if Funutation is contacted by the press, a student’s full name may be used in print, radio, TV and other mediums. We may not have the opportunity to contact all families for permission before the press arrives, so we have created a blanket policy. We thank you for your cooperation.

5.6 All projects and work created while at Funutation Tekademy Camps may be used by Funutation Tekademy Camps in camp promotional materials and other print and online media for camp purposes.

5.7 Digital Video participants may have their movie posted to the Funutation website, which will include the credits and may list student full names. These projects may be shared and used by corporate partners, the media, or other organizations who work with Funutation. In addition, you agree that any digital movie created during the Funutation Tekademy Camps course may be submitted to a film festival by Funutation and/or any of the student(s) in the group that created the movie. You understand that Funutation LLC, its owners, agents, partners, facility providers, and employees will not be held liable for damages and injuries associated with said publishing, including any and all claims based on negligence.

5.8 Video and computer games played at Funutation Camps are rated E for Everyone, T for Teen, and, at times, M for Mature; and selected at the sole discretion of Funutation Tekademy Camps. Movies played at Funutation Tekademy Camps are rated PG and PG-13 and selected at the sole discretion of Funutation Tekademy Camps. You understand that Funutation Tekademy Camps defines "Teen Students" as those turning thirteen (13) years old by December 31, 2008 or earlier.

5.9 Funutation Tekademy Camps has adopted the policy of allowing the use of some select games rated "T" for Teen and "M" for Mature to be used as part of our curriculum in a supervised environment in order to offer the most cutting-edge experience for our campers. Please know that we make every effort to minimize exposure to any games not appropriate for these age groups.

5.10 Funutation Tekademy Camps makes reasonable effort to send each student home with a working game or project, but due to the complexity of systems there will be instances when the game or project will not work on an individual's home system. In these rare cases, Funutation does not take responsibility for non-functioning games or projects. A student can contact Funutation Tekademy Camps to request a duplicate. Game and project duplicates are tested prior to sending to the student. If the tested duplicate does not function on the home system again, Funutation Camps is under no obligation to further pursue resolution.

5.11 Funutation Tekademy Camps reserves the right to cancel a course, activity or session. If a session is canceled, you will receive a refund for all monies paid to Funutation Tekademy Camps for that session (if one is not available in the local vicinity for the same dates) or enroll child into another session.

5.12 The son/daughter/ward may get sick, or injure him/herself as a result of his/her participation in Funutation Tekademy Camps, and hereby release Funutation LLC, its agents, employees, partners and facility providers, from liability. If Student is old enough to drive with a valid state driver's license, he/she may bring a vehicle to camp with written permission from a parent or guardian. It is understood that students are not allowed to transport other students in their vehicles under any circumstances (per American Camping Association Safety Standards). Furthermore, if theft or damage should occur to the vehicle while at camp, or in transit to or from camp, Funutation Tekademy Camps will not be held responsible for any damages. You will be asked if the student has or does not have permission to take public transit unsupervised or to drive him or herself to and from camp without a signed note.

5.13 THIS AGREEMENT CONTAINS A BINDING ARBITRATION PROVISION WHICH MAY BE ENFORCED BY BOTH PARTIES. ARBITRATION IN LIEU OF LITIGATION: Any dispute arising out of or relating to this Agreement, Students participation at Funutation Tekademy Camps or otherwise arising between the parties, including, without limitation, any Students statutorily created or protected rights, as permitted by applicable state or federal laws, shall be settled by arbitration in the state and county in which the camp is held, in accordance with the Commercial Rules of the American Arbitration Association, and judgment upon the award rendered by the arbitrator(s) may be entered in any court of competent jurisdiction. The prevailing party in the arbitration shall be entitled to recover expenses including costs and reasonable attorney's fees associated therewith. Should any part of this contract be found invalid or not enforceable by a court of law, then the remaining portion shall continue to be valid and in force. You will be asked to acknowledge that you understand the terms of the ARBITRATION AGREEMENT; that you understand it, and agree to comply with all of its terms and provisions.

5.14 The Funutation Tekademy Camps Code of Conduct must be jointly read and submitted by both Student and Parent/Guardian. As the named Funutation Camp student, parent and student must understand that student must act in a way that is in keeping with the Code of Conduct.

Both must understand that student can be dismissed from camp if actions or attitudes seem to be harmful to the camp atmosphere or to other campers at the camp. Both know student can be dismissed from camp for the following reasons: Drug/Alcohol/Tobacco use, Viewing pornography or any inappropriate material on the Internet, Inappropriate language (swearing, using bad words, racial slurs), Physical violence against camper or Funutation staff, Damage to University facilities or camp equipment, Stealing property of others, Inappropriate use of any equipment, Sexual Harassment of camper or Funutation staff, Internet hacking, damage to dorm room.

5.15 The following items CANNOT be brought to camp: Laptop or Desktop computers (Participants are provided with a computer at camp, and we must be able to monitor internet use at all times. Certain filtering software is placed on Funutation computers, and this may not be the case with a personal computer. It is for the safety and security of all that we ask participants to not bring personal computers to camp.) Televisions, DVD players, VCRs, Cellular Phones, and game consoles. (We ask campers not to bring these items because we have many special activities planned. We want campers to participate in group activities and socialize with other campers. We offer many activities, including movie nights and gaming tournaments.) Roller blades, skateboards, shoes with wheels: unless this is the participant's only mode of transportation to/from camp, in which case, it must be checked in upon entrance to camp/checked out upon exit to camp. Personal pets or animals are not allowed to be brought or kept at camp.

5.16 If possession of illegal substances or weapons is suspected, student(s) will be subject to search and seizure. If possession of illegal substances or weapons is found, students(s) will be dismissed from camp immediately. Student (and therefore Parent/Guardian) is responsible for any personal items brought to camp and loaned at camp. Student agrees to respect all Funutation Staff members and campers while treating the facilities and equipment with great care.

5.17 Parent and student understand the policy that it is OK but not recommended to bring the following electronic devices to camp, and they may not be used or turned on during instructional time: Handheld Game Consoles (with appropriate games), CD Player, Cell Phone, iPod, etc. (with headphones), Personal Digital Assistant (Such as palm pilot).

5.18 If you have any doubt about a particular item, please phone the Funutation Tekademy Camps office with any questions before you get to camp. Parent and student understand that Funutation Tekademy Camps reserves the right to dismiss Student from camp without any prior warning for violating any of the terms of the Student Code of Conduct. Both parent/guardian and student must review the Code of Conduct and agree to comply with all its terms and provisions.

5.19 Funutation Tekademy Camps makes every effort to prevent students from being exposed to inappropriate web content. As a safeguard, Funutation installs internet filtering software on all camp computers. No software is 100% perfect, and some inappropriate content may inadvertently be accessed. Funutation Tekademy Camps makes every reasonable precaution to guard against inappropriate material from being viewed. If inappropriate content is viewed, the instructor will follow standard camp protocol. Please understand that students found in violation of our "common sense" internet policy may be removed from camp without receiving a refund.

6. DISCLAIMER

6.1 Rights Reserved

Funutation Tekademy Camps LLC reserves the right to update or modify these terms and conditions at anytime. Funutation LLC is not affiliated with any of our host country clubs, colleges, universities, recreation centers, high schools, middle schools, grade schools, or campgrounds. Activities, guest speakers and tech tours will change from week to week and may not apply to all locations. We reserve the right to cancel a session if participation numbers are not adequate. If a suitable camp replacement week is not found, a full refund will be issued.

6.2 Changes To Services

Funutation Tekademy Camps may change these provisions at any time. For example, we may add, delete or amend terms of functions.
